1- PREAMBLE

Autodistribution, with capital of €69,679,124, whose registered office is located at 22, avenue Aristide Briand - 94742 ARCUEIL CEDEX, registered with the RCS CRETEIL B 962 227 351, processes Personal Data (as defined below) as part of its activity, which includes the Personal Data of individuals collected by the various brands and companies of the group as well as via their websites.

The purpose of this "Personal Data Protection Policy" is to inform all natural persons concerned ("You") about the way in which Autodistribution collects and uses Personal Data and about the means available to You to control this use. The purpose of this policy is also to define the commitments made by Autodistribution concerning compliance with the principles of European Regulation 2016/679, known as the General Data Protection Regulation (GDPR).

This policy does not apply to any third party websites mentioned on the Autodistribution group websites.

2- FIELDS OF APPLICATION

This Policy sets out the principles and guidelines for the protection of Your Personal Data, which includes the Personal Data collected on the Autodistribution websites.

Autodistribution collects Personal Data online (including by email), on paper or verbally; this Policy applies regardless of the method of collection or processing.

The concept of personal data ("Personal Data") refers to any information relating to an identified or identifiable natural person. A person is "identifiable" if he or she can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to that person.

The Personal Data that You agree to communicate to us is subject to the provisions of this Policy and the applicable Terms of Use.

3- DATA COLLECTED

3.1 General information

In order to access certain functionalities of the sites and for business purposes, You must communicate certain Personal Data to Autodistribution. The Personal Data collected may include, but is not limited to:

  • Full name
  • Postal address
  • Email address
  • Telephone number(s)
  • Login and password
  • Registration number
  • CV
  • Type of organisation (company, school, university, etc.), name of organisation, size of organisation, department and job title
  • Financial details (RIB)
  • IP address
  • Any other Personal Data that may be relevant for the purposes set out below.

However, the Personal Data collected is limited to that which is strictly necessary for the purposes set out in Article 4 below.

You are free to choose whether or not to provide all or part of Your Personal Data. No personal data is collected unless You have voluntarily decided to provide it. However, if You choose not to provide it, such a decision may prevent the achievement of the objectives described in article 4 below, certain services and certain functionalities of the websites may not function.

3.2 Children's data

Autodistribution and the companies in its network do not intend to have children under the age of 15 visit their websites and therefore do not collect their Personal Data. However, if this is not the case, Autodistribution and the companies in its network undertake to obtain the consent of the parental authority for the data to be processed, to protect it and to consider it as sensitive data.

4- COLLECTION METHOD AND PURPOSE

As indicated above, You provide Your Personal Data on a voluntary basis. This Personal Data Protection Policy applies regardless of the method of collection (online, on paper or verbally). In the event of online collection, this Personal Data Protection Policy will appear on the Autodistribution websites and, in the event of collection on paper or verbally, You will be informed of the existence of this Personal Data Protection Policy.

Personal Data is generally collected for the needs of certain functions of the websites and for the needs of Autodistribution's activity

Autodistribution collects and uses Your Personal Data for the needs of its activity and in particular for:

  • Managing staff recruitment
  • Career management and staff training
  • Personnel administration
  • Customer and supplier relationship management
  • Marketing and advertising initiatives
  • Managing the safety of goods and people
  • Management of advertising and communication tools (fixed and mobile phone calls, email) and information systems.

5- COOKIES

The Autodistribution Group websites are:

When you visit one of these Sites, cookies may be installed on your device (computer, tablet, etc.). A cookie is a small text file placed on your device when you visit a website or view an advertisement. A cookie cannot damage the device you are using. A cookie stores information relating to browsing on the Site (pages consulted, date and time of consultation, etc.). This information may be read during following visits. Under no circumstances do these cookies contain personally identifiable information. Under no circumstances are cookies intended to fraudulently collect personal data.

We use different types of cookies for different purposes.

Autodistribution reminds you that by disabling Cookies, your browsing on one of its Sites may be impaired and recommends that you configure your browser taking into account their purpose.

6- CONDITIONS FOR PROCESSING AND STORING PERSONAL DATA

The "processing" of Personal Data includes in particular the use, storage, recording, transfer, adaptation, analysis, modification, declaration, sharing and destruction of Personal Data in accordance with what is necessary in view of the circumstances or legal requirements.

All Personal Data collected is kept for a limited period depending on the purpose of the processing and only for as long as required by the applicable legislation.

7- LINKS TO SITES NOT ADMINISTERED BY AUTODISTRIBUTION

Autodistribution websites may suggest that you visit hypertext links leading to other websites. The Site's link to these sites is deemed to provide additional qualified information. Under no circumstances can Autodistribution be held responsible for the content of these sites, which it does not publish, the User acknowledging that these sites and services of third parties or partners are totally independent of Autodistribution. The proposed redirection to a third party site does not constitute a recommendation and Autodistribution is under no circumstances responsible for the editorial content proposed on the sites concerned.

8- DATA TRANSFER

If You access the Websites from a country outside the European Union whose legislation on the collection, use and transfer of data differs from European legislation, You agree to the transfer of Your Personal Data to the European Union as part of Your browsing on the Websites.

If Autodistribution becomes aware that a third party is using or disclosing Personal Data without respecting this Personal Data Protection Policy or in violation of applicable legislation, Autodistribution will take all reasonable measures to prevent or put an end to such use or disclosure.

Autodistribution may also transfer Your Personal Data to third parties if Autodistribution considers that such a transfer is necessary for technical reasons (for example, for the hosting of websites), as part of Autodistribution's legitimate interests or to meet legal obligations. These transfers may be made by Internet, post, fax or any other method that Autodistribution deems appropriate and in compliance with the applicable legislation.

9- RIGHT OF ACCESS, RECTIFICATION, PORTABILITY AND DELETION

Autodistribution has put in place suitable Personal Data protection systems to ensure that Personal Data is used in accordance with the above purposes and to ensure that it is accurate and up-to-date.

You have the right to obtain the communication of Your Personal Data held by "Autodistribution" and the companies in its network. You also have the right to request the rectification, portability or deletion of Your Personal Data. You also have the right to limit the processing of Your Personal Data.

10- DATA SECURITY AND RECIPIENTS

Autodistribution takes care to protect and secure the Personal Data that You have chosen to communicate to it, in order to ensure its confidentiality and prevent it from being distorted, damaged, destroyed or disclosed to unauthorised third parties.

Autodistribution undertakes to respect the principles of Privacy by design and Privacy by default and, as such, has put in place physical, electronic and organisational protection measures to prevent any loss, misuse, unauthorised access or distribution, alteration or possible destruction of this Personal Data. However, despite Autodistribution's efforts to protect Your Personal Data, Autodistribution cannot guarantee the infallibility of these security measures due to the inevitable risks that may arise when processing Personal Data.

As all Personal Data is confidential, access to it is limited to Autodistribution employees and service providers who need it to carry out their mission.

11- CONFLICT RESOLUTION

Although Autodistribution has taken reasonable measures to protect Personal Data, no transmission or storage technology is totally infallible.

However, Autodistribution is concerned to guarantee the protection of Personal Data. If You have reason to believe that the security of Your Personal Data has been compromised or that it has been misused, You are invited to contact the Autodistribution Personal Data Protection Correspondent at the above address (Cf. paragraph 9)

Autodistribution will investigate complaints concerning the use and disclosure of Personal Data and will attempt to resolve them in accordance with the principles set out in this Personal Data Protection Policy.

13- EFFECTIVE DATE AND REVISION OF THE PERSONAL DATA PROTECTION POLICY

This Personal Data Protection Policy may be updated according to Autodistribution's needs and circumstances or if required by law.

This Personal Data Protection Policy will come into force on 1 July 2018.
